Terms and Conditions

1. Definitions
• Link My Trade (“LMT”, “we”, “us”, “our”): The operator of the Link My Tradeplatform providing directory and connection services.
• Client: A homeowner, property manager, or business entity posting a job orsearching for a Tradie.
• Tradie: A tradesperson or trade business registered on the Platform to advertiseservices or receive leads.
• Platform: The Link My Trade website, mobile applications, and associated digitalinterfaces.
• Services: The directory, listing, connection, and administrative tools provided byLMT.
• External Reviews: Reviews or ratings sourced from third-party platforms(including Google or Facebook) and displayed on the Platform for informationalpurposes only.
• User: Any Client or Tradie accessing or using the Platform.

2. Platform Status & Consumer Law Disclosures
2.1 Venue-Only Declaration
Link My Trade is a passive directory and connection platform only.
• LMT is not a party to any agreement or transaction between a Client and aTradie.
• LMT does not provide, supervise, manage, control, or warrant any trade services.
All negotiations, pricing, scope of work, and payments occur directly between Clients and Tradies, outside the Platform.
Nothing in these Terms creates any agency, partnership, joint venture,employment, or fiduciary relationship between LMT and any User.

2.2 Fair Trading Act 1986 – “In Trade” Disclosure
• Tradies: Under section 28B of the Fair Trading Act 1986, all Tradies must clearly disclosethat they are operating “in trade.” By registering, Tradies warrant that they areoperating in trade and comply with all applicable laws.
• Platform: LMT operates in trade only for the provision of directory services and is not asupplier of the physical trade services offered by Tradies.2.3 Consumer Guarantees Act 1993 (CGA)
• Clients: Clients retain all statutory rights they may have against Tradies under the CGA.LMT does not provide these guarantees.
• Tradies (B2B): To the maximum extent permitted by section 43 of the CGA, LMT and Tradiesagree to contract out of the CGA in relation to the subscription and directoryservices provided by LMT.

3. Eligibility & Account Integrity
3.1 Eligibility
• Users must be 18 years or older.
• Users must have legal capacity to enter binding agreements.

3.2 Verification Disclaimer
LMT may display verification indicators (such as “Verified” badges or tradelogos), reflecting point-in-time checks of publicly available registers (e.g. NZBN).
• Verification is not an endorsement or warranty.• Verification does not confirm competence, insurance, or ongoing compliance.
• LMT does not undertake ongoing monitoring unless expressly stated.
Clients are solely responsible for final due diligence, including sighting currentlicences and insurance.

3.3 Prohibited Conduct
Users must not:
• Post false, misleading, or deceptive content
• Create multiple accounts or bypass platform controls
• Use automated tools, bots, scrapers, or AI systems to extract Platform data forany purpose

4. Quality Guideline & 4-Star Standard
To promote professionalism and transparency, LMT maintains a non-guaranteedquality guideline.
• LMT may, at its sole discretion, review trends and information relevant to aTradie’s ongoing suitability for participation on the Platform.
• A 4-star or higher average rating is promoted as a guideline only and does not represent a guarantee or endorsement.
LMT may issue warnings, suspend, or remove Tradies where informationindicates potential risks to platform integrity, including allegations involving safetyconcerns.

External Information
Where lawful, LMT may consider publicly available information solely to assessplatform suitability. This does not constitute monitoring, investigation, or endorsement.

5. Reviews & External Reviews
5.1 Platform Reviews
• Must be based on genuine experiences
• Represent user opinions only
• Are publicly visible
• May be removed if false, abusive, or misleading

5.2 External Reviews
• External Reviews may be displayed for informational purposes only.
• They are not verified, moderated, or endorsed by LMT and may not reflect currentperformance.

For clarity:
• Platform reviews are the primary feedback mechanism for LMT decision-making.
• Clients must treat External Reviews as a supporting tool only.

6. Privacy
LMT handles personal information in accordance with the Privacy Act 2020(including any amendments in force from time to time).
Our Privacy Policy is incorporated by reference.
Termination or account closure does not require LMT to delete information whereretention is required for legal, compliance, or dispute-resolution purposes.

7. Financial Terms & Subscriptions
• Tradie access is subscription-based.
• Fees are non-refundable, regardless of outcomes, suspension, or termination.
• Suspension or termination does not entitle a Tradie to any refund.

8. Disputes & Liability
8.1 User-to-User Disputes
Disputes are strictly between Clients and Tradies. LMT may provide limitedadministrative assistance at its discretion but has no obligation to mediate.

8.2 Limitation of Liability
Except where liability cannot be excluded by law, LMT’s total liability is limited tosubscription fees paid in the six (6) months preceding the claim.

8.3 Indemnity
Users indemnify LMT against losses arising from breaches of these Terms,interactions with other Users, or legal violations.

9. Intellectual Property (IP)
• LMT Ownership: All content on the Platform (logos, text, software, and design) isthe property of LMT.
• Licence to Use: LMT grants you a limited, non-exclusive, non-transferablelicence to access the Platform for its intended purpose. You must not "scrape", copy, or repurpose Platform data without written consent.
• User Content: By posting content (photos, reviews, profiles), you grant LMT an aroyalty-free, perpetual licence to use and display that content to operate andpromote the Platform.

10. Changes
LMT may update these Terms at any time. Continued use constitutesacceptance.

11. Governing Law
These Terms are governed by the laws of New Zealand. Users submit to theexclusive jurisdiction of New Zealand courts.
